They've never been given permission and there is no caselaw yet, doesn't mean they are allowed to. GPL2 actually in some ways was saner than GPL3 on this - you could sensibly argue the key was part of the source/build environment but it didn't then get muddled in with questions like ROMs which the new GPL3 wording is a bit messy about still.
