Have you actually tested this?  I thought it was handled by:

                /*
                 * Global init gets no signals it doesn't want.
                 */
                if (unlikely(signal->flags & SIGNAL_UNKILLABLE) &&
                    !signal_group_exit(signal))
                        continue;

in get_signal_to_deliver().
